Welcome to Embroidery and Prints Online (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website and services, including the purchase of our products. By using our site or placing an order, you agree to these Terms.

2) Eligibility

You must be at least 18 years old to place an order. You may purchase as a consumer or on behalf of a business; by ordering, you confirm you have authority to bind any organisation on whose behalf you act.

3) Our Products (Including Personalised Items)

  • Descriptions & Colours: We aim for accuracy, but minor variations (including colour differences due to screens, threads, inks, and garments) may occur.
  • Tolerances: Embroidery/print placement and size may vary within normal manufacturing tolerances.
  • Proofs & Approvals: For custom work, we may provide digital proofs/mock-ups. Please check carefully—production begins after approval. Errors present in an approved proof are your responsibility.
  • Customer-Supplied Artwork: You warrant that you own or have permission to use any design, logo, or text supplied and that it does not infringe third-party rights. You grant us a non-exclusive licence to use it solely to fulfil your order. We may refuse content that is unlawful, offensive, or infringes rights.

4) Prices, Taxes & Payment

  • Prices are shown in GBP and include VAT where applicable. Shipping costs are shown at checkout.
  • We may change prices at any time before you place an order. Obvious pricing errors are not binding.
  • Payment is taken via our checkout provider(s). Your order is accepted when we send an order confirmation.

5) Ordering & Contract Formation

  • Your order is an offer to buy; our confirmation email acknowledges receipt. A contract forms when we accept your order (usually when we dispatch or explicitly confirm acceptance).
  • If we cannot fulfil all or part of an order (e.g., stock or production constraints), we’ll notify you and provide a refund for any unavailable items.

6) Shipping & Delivery

  • Estimated dispatch and delivery dates are provided at checkout and in your confirmation. They are estimates, not guarantees.
  • Risk passes to you on delivery. Please inspect parcels on arrival and notify us of any issues promptly.
  • International orders may be subject to customs duties/taxes payable by you. We are not responsible for delays caused by customs.

7) Cancellations, Returns & Refunds

Statutory rights: Nothing in these Terms affects your legal rights under the Consumer Rights Act 2015 and applicable UK consumer law.

  • Personalised/Made-to-Order items: Because they are made to your specification, these items are non-cancellable and non-returnable once production has begun, except if faulty or not as described.
  • Non-personalised items: If you are a consumer, you may cancel within 14 days of delivery, then return the item(s) within a further 14 days. Items must be unused and in resaleable condition. You’re responsible for return shipping unless the item is faulty.
  • Faulty or Misdescribed items: Contact us within a reasonable time with photos and your order number. We may repair, replace, or refund as appropriate.
  • Return Process: Email info@embroideryandprintsonline.co.uk for an RMA and instructions before sending anything back.

8) Content You Provide

  • You are responsible for ensuring your submitted content is accurate, lawful, and free of third-party rights issues.
  • You agree to indemnify us against claims, damages, costs, and expenses arising from content you supply that infringes rights or violates law.

9) Intellectual Property (Site & Designs)

All site content (images, text, graphics, logos) is our property or used under licence and is protected by intellectual property laws. You may not copy or reuse without our permission. Customer-supplied designs remain your property; we only use them to fulfil your order (and to display your finished work in our portfolio/marketing only if you’ve consented).

10) Promotions, Gift Cards & Discounts

  • Offers and discount codes are subject to separate terms and may be withdrawn at any time.
  • Only one discount can be applied per order unless stated otherwise.

11) Liability

  • We are responsible for loss or damage you suffer that is a foreseeable result of our breach or negligence.
  • We do not exclude liability for death or personal injury caused by our negligence, fraud, or any matter where liability cannot be excluded under law.
  • We are not liable for business losses (e.g., loss of profit, revenue, goodwill, or data) if you use our products for commercial purposes.

13) Force Majeure

We are not liable for delay or failure caused by events beyond our reasonable control (e.g., supplier issues, shipping disruptions, extreme weather, strikes, or regulatory actions).

14) Changes to These Terms

We may update these Terms from time to time. The version posted on this page at the time of your order will apply to that order.

15) Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
